1. By way of the present petition, petitioners seek directions thereby
quashing of FIR No.46/2002 registered at Police Station Seelampur,
Delhi, for the offences punishable under Sections 498A/406/34 IPC
against them.
2. Learned counsel appearing on behalf of the petitioners submits that
aforesaid case was registered on the complaint of respondent No.2,
namely, Ms. Poonam Rani @ Poonam Choudhary due to some
matrimonial disputes. Thereafter, petitioners and respondent No.2 settled
the matter and pursuant thereto, marriage between the petitioner No.1 and
the respondent No.2 was dissolved vide ex parte decree of divorce dated
29.03.2010. Though, thereafter, the petitioner No.1 and the respondent
No.2 started living together as husband and wife but the said reunion

could not continue. Thereafter, the matter stands settled between the
petitioners and the respondent No.2 before the Delhi Mediation Centre
Karkardooma Courts, Delhi, vide settlement dated 23.03.2015. As per the
said settlement, the respondent No.2/complainant shall reside separately
with her children, namely, Deepa @ Kajal and Ankit, aged 16 years and
14 years respectively and custody of both the children shall remain with
the respondent No.2. The respondent No.2 also agreed not to claim any
istridhan, permanent alimony or maintenance for herself and her children
from the petitioner No.1.
