Supreme Court on Section 319 of CrPC

The Supreme Court held that a person can be made accused by a trial court in case evidence crops up during the proceedings even if he/she hasn’t been named in the FIR/ Charge-sheet.

Section 319 of Criminal Procedure Code empowers the trial court to proceed against a person who appears to be guilty of an offence but not named in the FIR/ Charge-sheet.
