M/S Excellent Investment … vs State & Anr. on 3 July, 2015

1. Vide the present petition, the petitioner seeks directions
thereby quashing the FIR No.422/2014, registered at Police Station
Nand Nagari for the offences punishable under Sections
471/406/420/120-B/468/34 IPC and the proceedings emanating
thereto against the petitioner.
2. Learned counsel appearing on behalf of the petitioner submits
that except the offence punishable under Section 420 IPC, no other
offence have been made out against the petitioner. He further
submits that the respondent No.2/complainant has already settled all

the disputes with the petitioner and the complaint does not want to
pursue the matter further against the petitioner.
3. Mr. Dudeja, learned Additional Public Prosecutor appearing
on behalf of the State submits that case against the petitioner is only
under Section 420 IPC as come out in the investigation. The
respondent No.2/complainant has come forward to get the FIR in
question quashed, therefore, the State has no objection if the present
petition is allowed.
