1. By way of this petition filed under Section 482 of the Code of
Criminal Procedure, 1973, petitioners seek quashing of FIR No.284/2014
registered at Police Station Jaitpur, New Delhi, for the offences
punishable under Sections 498A/406/34 IPC and the consequential
proceedings emanating therefrom against them.
2. Learned counsel appearing on behalf of the petitioners submit that
the aforesaid case was registered on the complaint of respondent No.3,
consequent upon certain disputes having arisen after the engagement of
petitioner No.1 with respondent No.3 and thereafter, no marriage could be
solemnised. It is also submitted that though the FIR has been registered
for the offences punishable under Section 498A/406/34 of the IPC, in fact
it should have been only for the offences punishable under Section 406/34

of the IPC as the marriage was not taken place. The case is at the initial
stage of trial as charge sheet has been filed, however charges have not
been framed. Meanwhile, the respondent Nos.2& 3 as well as petitioners
have amicably settled their disputes vide settlement deed dated
12.08.2014 for an amount of Rs.50,000/- which has since been paid by
petitioners to respondent Nos.2 & 3, which facts have not been disputed
by the respondent Nos.2 & 3.
