1. The petitioner has filed the abovementioned petition under
Section 9 of the Arbitration and Conciliation Act, 1996, inter alia, to
restrain the respondent from dispossessing the petitioner from the
commercial outlet and not to act contrary to letter dated 10th June
2015 and 12th June 2015.
2. Brief facts as per the case pleaded in the petition are that the
petitioner was awarded the contract for a period of ten years
commencing from the COC (the Operational Contract Period) during
which the petitioner is authorized to exclusively operate and
maintain the facility in accordance with the provisions of the
agreement dated 8th August, 2005. The possession of the same was
handed over to the petitioner on 23rd August, 2005.
