1. By way of this petition filed under Section 482 of the Code of
Criminal Procedure, 1973, petitioners seek quashing of FIR No.109/2014
registered at Police Station CAW Cell Nanakpura, Delhi, for the offences
punishable under Sections 406/498A/34 IPC and the consequential
proceedings emanating therefrom against them.
2. Learned counsel appearing on behalf of the petitioners submits that
the aforesaid case was registered on the complaint of respondent No.2,
namely, Ms.Harmeet Kaur, consequent upon certain matrimonial and
domestic disputes having arisen between the parties. The case is at the
initial stage of investigation as charge sheet has not been filed as yet.
Meanwhile, the respondent No.2 and the petitioner No.1 have amicably
settled their disputes vide Memorandum of Understanding (MoU) dated
22.12.2014 for a total sum of Rs.5,50,000/- (Five Lacs Fifty Thousand).
As per the said settlement, two instalments of Rs.1,80,000/- (One Lac
Eighty Thousand) and Rs.1,85,000/- (One Lac Eighty Five Thousand)
respectively were paid at the time of recording first motion petition and
second motion petition for divorce by mutual consent and the balance
amount of Rs.1,85,000/- (One Lac Eighty Five Thousand) is paid today in
the Court by way of Pay Order No.268306 dated 05.10.2015 drawn on
State Bank of India, Jangpura, New Delhi, in favour of the respondent
No.2, which facts have not been disputed by the respondent No.2.
