Delhi High court Admits Appeal in CA Exam Result mismatch matter

In the CA exam result mismatch matter, a Division bench of Delhi High court through HMJ S. Ravindra Bhat and HMJ A.K. Chawla has admitted the appeal against the order of the Single bench, in January, whereby the single Judge dismissed the writ petition filed by Milind Agarwal and Ors challenging the results of Chartered Accountants ( CA Exam Final) examination held in November 2017.

Against the decision of the Single bench, the petitioners approached the division bench, the bench while admitting the appeal, asked the Institute to produce relevant documents before the Court. The order reads as “The respondent Institute shall produce the relevant official records pertaining to the receipt and compilation of the documents, the moderation procedure adopted leading to the final declaration of results which would also include the relevant notings etc.”

When we approached the main counsel, Mr. Vikas Nagwan he mentioned it as a small victory for the CA students. The ICAi is a statutory body and any decision of ICAI effects a large number of students hence the procedure adopted by ICAI should be transparent and fair. Once de-codification of the result takes place, any change thereafter is bound to be affected by personal bias and individual interests and in the present case there are thousands of the candidates which are adversely affected, added Mr. Vikas Nagwan (Advocate).
