Nursery Guidelines by the Lieutenant Governor set aside by the Delhi High Court

In its recent ruling, the Delhi High Court has set aside the guidelines issued by the LG in nursery admission case, where he had introduced a point system for seeking admission in nursery.

The Court opined that the power to decide a child’s school should rest with parents and should not be regulated by “his position on a map”. The Court said that the children should have the option to go to a neighbouring school, but their choice shouldn’t be restricted to a school situated in their locality only.

The Court held that the administrative autonomy of the schools in their day – to – day administration could not be restricted by official orders issued without any authority of law.

This verdict has come as a relief to the private unaided schools  and ensure them “maximum autonomy”.

The LG’s order was challenged in the High Court by the Forum for Promotion of Quality Education for All and the Action Committee of Unaided Recognised Private Schools.
