1. By way of this petition filed under Section 482 of the Code of
Criminal Procedure, 1973, petitioner seeks quashing of FIR No.27/2006
registered at Police Station Mayur Vihar, Delhi, for the offences
punishable under Sections 498A/406/34 IPC and the consequential
proceedings emanating therefrom against him.
2. Learned counsel appearing on behalf of the petitioner submits that
the aforesaid case was registered on the complaint of respondent No.2,
namely, Smt.Hemlata, consequent upon certain matrimonial and domestic
disputes having arisen between the parties pursuant to her marriage dated
22.02.2004 with petitioner. The police chargesheeted the petitioner and

after framing of charges by learned Trial Court, matter is pending for trial.
Meanwhile, the respondent No.2 & petitioner have amicably settled their
disputes vide compromise dated 18.02.2012 for a total sum of Rs.4.00 Lac
before Delhi Mediation, Karkardooma Courts, Delhi. Consequent to the
said settlement, marriage between the petitioner and respondent No.2 has
been dissolved vide decree of mutual divorce dated 06.06.2015 under
Section 13 B (2) of the Hindu Marriage Act, 1955. Moreover, the agreed
amount has been paid by the petitioner, thus, respondent No.2 does not
wish to pursue her case further against him.
